(Personal Information Protection Policy)

Global Nexus Inc. (the “Company”) recognizes that properly protecting personal information is an important social responsibility, and has established this Privacy Policy (this “Policy”) as its basic policy for the handling of personal information. In order to ensure that users can use the international dating and matching service app “Glove” operated by the Company (including services provided through web browsers, collectively, the “App”) with peace of mind, the Company will appropriately manage and use the important personal information and other information provided by users of the App (including those who make inquiries regarding the Company’s services, collectively, the “Users”), and will comply with the Act on the Protection of Personal Information of Japan (the “APPI”) and other relevant laws and regulations, as well as the EU General Data Protection Regulation 2016/679 (“GDPR”) and other relevant laws and regulations (including the UK General Data Protection Regulation), and this Policy.
Unless otherwise defined, the terms used in this Policy shall be in accordance with the APPI.

1. App Provider and Representative that Collect Information

The entity responsible for the personal information and other data obtained from customers under this Policy, and the data controller under the GDPR, is Global Nexus Inc. (the “Company”), and its name, representative and address are as follows:

2. Scope of Application of this Policy

This Policy applies to personal information obtained by the Company through the use of the App. The App may contain links to external websites. The Company is not responsible for the handling of personal information on such external websites. Please be sure to review the privacy policies of each external website before using them.

3. Scope of Personal Information Obtained by the Company

In connection with the use of the App by Users and inquiries made to the Company, the Company obtains personal information and other information (including information related to individuals and collectively referred to as “Personal Information”) from the following sources:

  • Information obtained directly from Users:
    Email address, nickname, gender, date of birth entered by the User, country of origin, the User’s profile, text, images and other content sent within the App as messages, information sent when making inquiries, and date of birth stated on the User’s identity verification documents (such as driver’s license, passport, etc.).

  • Information obtained automatically:
    Information generated through cookies and similar technologies (“Cookies”), IP address, general location information, type of operating system and browser, type of device, device ID, language, information relating to uploaded data, timestamps related to login and use, and other similar information related to the device and communication environment.

  • Information obtained from third parties:
    Information related to the payment of usage fees.

4. Purposes of Use of Personal Information and Legal Basis for Processing

The Company uses or processes the following information for the purposes and on the legal bases set out below:

  • Email address, date of birth entered by the User, date of birth stated on the User’s identity verification documents
    (Purpose of use) For authentication of persons using the App and for age verification, as well as for responding to conduct that violates laws and regulations.
    (Legal basis) Performance of a contract for the provision of services through the App, and necessary measures to comply with legal obligations.

  • Nickname, date of birth entered by the User, country of origin, User’s profile
    (Purpose of use) For disclosure to other Users and for the provision of services through the App.
    (Legal basis) Performance of a contract for the provision of services through the App.

  • Text, images and other content sent within the App as messages
    (Purpose of use) For sending and receiving communications with other Users and for the provision of the services, as well as for responding to conduct that violates laws and regulations.
    (Legal basis) Performance of a contract for the provision of services through the App, and necessary measures to comply with legal obligations.

  • Email address, information sent when making inquiries
    (Purpose of use) To respond to inquiries.
    (Legal basis) Consent of the User and the Company’s legitimate interests in meeting expectations for a response.

  • Information related to the payment of usage fees
    (Purpose of use) To determine whether or not the User is eligible to use services provided by the Company for a fee.
    (Legal basis) Performance of a contract for the provision of services through the App, and the Company’s legitimate interests in controlling the provision of paid services so that such services are not provided to those who do not pay the usage fees.

  • Cookies, IP address, general location information, type of operating system and browser, type of device, device ID, language, information relating to uploaded data, timestamps related to login and use, and other similar information related to the device and communication environment
    (Purpose of use) To analyze usage of the App in order to verify and improve the App, and to develop and market the Company’s services.
    (Legal basis) The Company’s legitimate interests in improving and developing the App and the services provided by the Company and providing highly reliable services.

  • All information obtained by the Company as set forth in the preceding items
    (Purpose of use) To protect the rights of the Company and the Users.
    (Legal basis) Legal obligations based on data protection laws and other laws, and the Company’s legitimate interests in conducting and protecting its business activities.

5. Data Sharing

The Company may provide a User’s Personal Information to third parties if the User has given consent. However, in the following cases, the Company may provide a User’s Personal Information to third parties to the minimum extent necessary without the User’s consent:

(a) When required by laws and regulations;
(b) When it is necessary for the protection of the life, body or property of a person and it is difficult to obtain the consent of the person;
(c) When it is particularly necessary for improving public health or promoting the sound growth of children and it is difficult to obtain the consent of the person;
(d) When it is necessary to cooperate with a national agency, a local government or a person entrusted by such entities in executing affairs prescribed by laws and regulations, and obtaining the consent of the person may impede the execution of such affairs;
(e) When providing information to an academic research institution for academic research purposes;
(f) When disclosure is based on a warrant issued by a court or other decisions, orders or laws and regulations of a court;
(g) When there is a lawful and proper inquiry from the public prosecutor’s office, the police or a supervisory authority;
(h) When the Company determines that an investigation is necessary regarding a violation by a User in relation to the App or the services provided through the App.

For the purpose of collecting data to analyze User behavior and improve the App, the Company uses the following information collection module (which is built into the App and has the function of obtaining User information):

7. Users’ Rights

Users have the following rights in relation to the Personal Information obtained and processed by the Company:

  • Right to be informed: Users may obtain information about the processing of their personal data.

  • Right of access: Users may confirm with the Company the Personal Information held about them and access such Personal Information.

  • Right to rectification: Users may request the correction of inaccurate or incomplete Personal Information.

  • Right to erasure: Users may request the deletion of Personal Information when it is no longer needed or when its processing is unlawful.

  • Right to restriction of processing: Users may request the restriction of the processing of their Personal Information where the conditions set out in the GDPR are met.

  • Right to data portability: Users may receive their Personal Information in a machine-readable format and transmit it to another controller.

  • Right to lodge a complaint: If Users believe that the Company’s processing of their Personal Information violates laws or regulations, they may lodge a complaint or objection with the supervisory authority in their place of residence. The Company would appreciate it if Users would first lodge complaints or objections with the Company so that it can promptly take appropriate remedial action.

  • Rights related to automated decision-making and profiling: Users may request not to be subject to decisions, including profiling, based solely on the automated processing of Personal Information that produce legal effects concerning them or similarly significantly affect them.

  • Right to withdraw consent: Users may withdraw, at any time and with effect for the future, their consent to the use and processing of their Personal Information by the Company. Such withdrawal will not affect the lawfulness of processing based on consent before its withdrawal.

8. Children’s Privacy

Use of the services is restricted to individuals aged 18 or older (excluding high school students), and individuals under the age of 18 are not permitted to use the services. Accordingly, the Company does not obtain or process information about persons under the age of 18. If a User who appears to be under the age of 18 is found within the App, the Company will take steps to delete such information as quickly as reasonably possible. Please contact the Company through the in-app violation report function or by email.

9. Retention Period

The Company retains Users’ Personal Information only for the period necessary to fulfill the purposes set out in this Policy or for the period required by law, and does not retain information of Users who have withdrawn from the App.
In addition, information sent as identity verification documents by Users will be deleted immediately after the Company completes age verification, and the Company will not retain such information.
However, the Company may retain the minimum amount of information necessary for a longer period for the purpose of maintaining accurate records of transactions relating to the exercise of rights based on legal grounds or in relation to complaints, objections or other exercises of rights by Users.

10. Security and Safety Management Measures

The Company takes necessary and appropriate measures to prevent the leakage, loss or damage of Users’ Personal Information and other information, and to otherwise ensure the safe management of such information.

11. Records of Data Processing

Whether acting as a data controller or a data processor, the Company keeps records of the processing of Personal Information in accordance with the provisions of the GDPR.

12. Amendments to this Privacy Policy

The Company will comply with applicable laws and regulations and other standards concerning the Personal Information it holds, and will review and improve the contents of this Privacy Policy as appropriate. When the Company changes the Personal Information it collects, changes the purposes of use, or makes other changes to this Privacy Policy, such changes will be announced by updating this page. The revised Privacy Policy will take effect when it is posted within the App or when the revision date is displayed on the Company’s website.
However, the Company will not use Users’ Personal Information in a new way without obtaining the Users’ consent.

14. Governing Law and Language

This Policy shall be governed by and construed in accordance with the laws of Japan.
This Policy is prepared in Japanese as the original, and versions in English or other languages are prepared for reference purposes only. In the event of any inconsistency or conflict between the Japanese version and versions in other languages, the Japanese version shall prevail.

15. Other

If the App becomes unavailable in certain countries or regions, the Company may delete the Personal Information of Users residing in such countries or regions.
